8) Payments, Subscriptions & Refunds (If Applicable)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Apptastic Coder AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

13) Indemnification

You agree to indemnify and hold Apptastic Coder and its affiliates harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

14) Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law rules. You agree that any dispute will be resolved exclusively in the courts located in Chennai, Tamil Nadu, India. You and Apptastic Coder waive any right to a jury trial where permitted by law.

15) Changes to the Services or Terms

We may modify or discontinue parts of the Services at any time. We may also update these Terms. Material changes will be indicated by updating the “Last updated” date above and, when appropriate, additional notice.
